When the data subject provides data through the websites of THE COCKTAIL, the Controller of the data provided is The Cocktail Global S.L. Furthermore, and depending on the reasons for contacting THE COCKTAIL, the data provided will be passed on to the corresponding group company. Thus, for example, if the data subject sends their CV to be included in the job exchange and there is a vacancy in one of the companies of the group, their data will be sent to the company in which the vacancy arises.
 

As a group, The Cocktail assumes the commitment to protect the personal data of all people whose data it processes, regardless of which group entity is ultimately responsible for the processing, and respecting the legal demands on data protection applicable to all group companies and with the utmost guarantee of data confidentiality and security.



For what purpose THE COCKTAIL group processes personal data 

THE COCKTAIL group, through its websites, can collect data from people who wish to make enquiries about our services or ask us for quotes. The purpose of the treatment of said data is to answer the query made by the data subject.

If the data subjects subscribe to our newsletters, they will receive communications in the email used to request registry and until they oppose the reception of said communications at any time in the future.

Similarly, the websites of THE COCKTAIL may include a Talent section for data subjects who wish to leave their CV in the job exchange of THE COCKTAIL group and take part in our open selection processes. Legal justification for the data processing

The processing of data provided by the subjects to answer questions they make through the different forms and means of contact in the group websites is based on the legitimate interest of THE COCKTAIL to answer the questions posed, in the case of the group companies in Spain.  

In the case of the group companies in Mexico and Colombia, the treatment is based on the data subject’s consent to this policy.

The treatment of the data subject’s email. Subscription to the newsletter is based on the consent of the owner of the email.

 

Data recipients

THE COCKTAIL is part of the group of companies indicated in the first section of this policy. Data may be passed between group companies in Spain depending on the type of query posed by the data subject.

Data may also be passed from the companies in Colombia and Mexico to the companies of the group in Spain.

The data will not be passed on to third parties outside the mentioned cases. 

 

Conservation period of the data

The period of conservation of the data will depend on the purpose for which they have been collected. Therefore, in the case of processing to answer a query, the data will be maintained until the query is answered. On the other hand, if it concerns subscription to the newsletter, the data will be held until the data subject wishes to cancel.

In any case, regardless of the conservation periods applied in each case, at the end of each purpose, THE COCKTAIL will apply its data blocking and deletion policies.

 

Rights of the data subject

If the data subject considers that their rights have not been adequately resolved, they may claim with the Spanish Data Protection Agency, in the case of Spain. With the Delegation for the Protection of personal data (depending on the Superintendence of Industry and Trade), in the case of Colombia. And with the National Institute of Transparency, Access to Information and Protection of Personal Data, in the case of Mexico.

Specifically, in the case of Spain, the data subject can exercise their rights of access, rectification or deletion, portability, limitation and opposition to the processing of their data.

And in the case of Mexico, the data subject can exercise rights of access, rectification, cancellation and opposition and also limit the use and disclosure of data.

For all countries, the owner of the data can withdraw their consent at any time, non-retroactively, and may also oppose the reception of electronic communications from THE COCKTAIL through the link available in each communication.

No minors’ data may be provided through THE COCKTAIL websites.

The first version of this policy dates from 25 January 2018, having been updated on 2 June 2022 to include the means of contact with the Data Protection Officer and the merger of the policies for all group companies.
