Privacy Notice

In this document, we define the personal data processing policies of THE COCKTAIL group for the data collected in the group's personnel selection processes.

 

Data controller of your data

The person responsible for processing the personal data provided by the candidate is The Cocktail Global S.L. This entity is the parent or head of THE COCKTAIL group, which is made up of the following companies:

In Spain:

- The Cocktail Global S.L. 

- The Cocktail Experience S.L. 

The three entities are located at calle Ríos Rosas, 26 in Madrid (28003). 

In Colombia:

- The Cocktail America S.A.S. 

Located at AV Cra 9 No. 101-67, Piso 2, Edificio Naos

In México:

Personal data may be passed between the companies of the group as indicated below in the section "Data Recipients".

The data provided by the candidate will be processed in order to be included in THE COCKTAIL group's job exchange and to take into account the data subject’s candidacy for selection processes now or in the future.

 

The candidate will receive electronic communications in which they will be informed of possible selection processes that fit the profile of the curriculum that they have provided and information of interest of the company so that can evaluate if is interested.

However, the candidate may unsubscribe at any time from the communication reception service, through the mechanisms that will be indicated in the electronic communication itself. Unless the candidate also want to unsubscribe from the labor exchange, you will continue to be part of the labor exchange

 

Legal justification for the processing of the candidate’s data

The processing of the data provided by the candidate to be taken into account in future selection processes of The Cocktail group is based on your consent by accepting the corresponding acceptance box or confirming your consent by email.  The sending of communications of interest to the candidate on selection processes of the group as well as information of interest of the group to consider their incorporation in the same, is based on the legitimate interest of The Cocktail.

 

Data recipients

THE COCKTAIL is part of the group of companies indicated in the first section of this policy. Data may be passed between group companies in Spain depending on the group company into which the candidacy fits.

And data may also be passed from the companies in Colombia and Mexico to the companies of the group in Spain, from which the job exchange and the selection processes are ultimately coordinated.

The management of candidates for THE COCKTAIL group may be outsourced to different technology and recruitment providers. Specifically, the Lumesse provider offers a technology that allows better management of the candidates' CVs. And the Hirint Global provider offers support in recruitment services.  Both providers process the data on behalf of THE COCKTAIL group as data processors within the European Area.

 

Conservation period of the candidate’s data

The CVs will be kept for a maximum of three years for participation in the different selection processes of THE COCKTAIL group. After this period, THE COCKTAIL will apply its data blocking and deletion policies.

 

Rights of the data subject

The data subject may exercise their rights at the addresses that appear at the top of this policy or at the email lopd@the-cocktail.com of THE COCKTAIL legal advisory area.

If the data subject considers that their rights have not been adequately resolved, they may claim with the Spanish Data Protection Agency, in the case of Spain. With the Delegation for the Protection of personal data (depending on the Superintendence of Industry and Trade), in the case of Colombia. And with the National Institute of Transparency, Access to Information and Protection of Personal Data, in the case of Mexico. 

Specifically, in the case of Spain, the data subject can exercise their rights of access, rectification or deletion, portability, limitation and opposition to the processing of their data. 

In the case of Colombia, the data subject can exercise rights of right of access, updating, rectification and deletion. 

And in the case of Mexico, the data subject can exercise rights of access, rectification, cancellation and opposition and also limit the use and disclosure of data. 

For all countries, the owner of the data can withdraw their consent at any time, non-retroactively, and may also oppose the reception of electronic communications from THE COCKTAIL in which our processes are reported.

 

Third party service providers

THE COCKTAIL websites may be hosted on third party infrastructures. At THE COCKTAIL, we always make sure that these suppliers meet security standards and are located in Europe.

 

Changes to this data protection policy

THE COCKTAIL reserves the right to modify its privacy policy in the event of a change in current legislation, jurisprudential doctrine or due to its own business criteria. If any changes are made to this policy, the new text will be published at this same address.

The first version of this policy dates from 25 January 2018, having been updated on 2 June 2022 to include the means of contact with the Data Protection Officer and the merger of the policies for all group companies.
